WASHINGTON (AP) ? The Supreme Court decided Friday not to consider reinstating the government's $550,000 fine on CBS for Janet Jackson's infamous breast-bearing "wardrobe malfunction" at the 2004 Super Bowl.

The high court refused to hear an appeal from the Federal Communications Commission over the penalty.

The 3rd U.S. Circuit Court of Appeals twice had thrown out the fine. The second time came after the Supreme Court upheld the FCC's policy threatening fines against even one-time uses of curse words on live television.

The appeals court said FCC's policy of excusing fleeting instances of indecent words and images appeared to change without notice in March 2004, a month after Jackson's halftime act. The judges said that made the agency's action against CBS "arbitrary and capricious."

But now, the FCC clearly has abandoned its exception for fleeting expletives, Chief Justice John Roberts said.

"It is now clear that the brevity of an indecent broadcast ? be it word or image ? cannot immunize it from FCC censure," he said. "Any future 'wardrobe malfunctions' will not be protected on the ground relied on by the court below."

JPMorgan likely to post $4 billion to $6 billion trade loss

NEW YORK (Reuters) - JPMorgan Chase & Co's losses from disastrous derivatives trades will likely amount to $4 billion to $6 billion in the second quarter, far more than the original estimate of at least $2 billion, according to a person familiar with the matter.

The bank has gotten out of more than half of the position, which it disclosed to investors last month, according to the source.

In exiting those trades, the bank dealt directly with hedge fund Saba Capital Management to close out that hedge fund's winning trades, according to a source familiar with the fund. Saba founder Boaz Weinstein was among the first to call attention to the outsize bets by a JPMorgan trader dubbed the "London Whale."

Despite the loss, JPMorgan is still expected to deliver the "solidly profitable" results that CEO Jamie Dimon predicted last week in congressional testimony, the source said.

The bank declined to comment.

The company has a variety of tactics it can use to offset the derivatives trading losses and boost its quarterly results, including selling securities at a profit to book one-time gains and drawing down its provisions for bad loans and lawsuits.

The bank, the biggest in the United States by assets, earns about $5 billion each quarter.

JPMorgan shares fell more than 5 percent early Thursday following a New York Times article that said internal projections at the bank in April said the losses could reach $8 billion to $9 billion, assuming worst-case conditions.

The shares dropped 2.45 percent to $35.88 at the close of New York Stock Exchange trading on Thursday while the KBW Bank stock index slipped 0.36 percent.

On May 10, Dimon, the bank's CEO, pegged the loss at $2 billion and warned the figure could rise by an additional "$1 billion or more." He has not publicly raised the loss estimate since, but has said the bank has made progress in limiting the loss.

Guessing the ultimate size of the loss has been a pastime on Wall Street, with estimates running as high as $5.9 billion, based on movements of obscure credit market indexes at the heart of the trades.

JPMorgan's stock, at Thursday's NYSE closing price of $35.88, has lost 12 percent since the bank's May 10 disclosure. It's recovered slightly from its drop of nearly 17 percent in the first week after the disclosure of the trading loss.

WATCHING FOR IMPACT ON EARNINGS

Dimon has promised to give a more complete report on the situation on July 13 when the company releases results for the second quarter.

More important than the exact amount of the trading loss, investors should be concerned about the impact of JPMorgan's response to this debacle on the company's earnings power, said Christopher Mutascio, an analyst at brokerage Stifel Nicolaus & Co.

"When they unwind that trade fully, those losses are going to be history," Mutascio said.

JPMorgan may move to keep up its profit by taking more one-time gains from selling securities that yield relatively high rates of interest, Mutascio said. Doing so would reduce profits in future quarters.

The bank has said it has already taken $1 billion of such gains to offset the losses. It sold an estimated $25 billion of profitable securities to take the gains.

Investors may also find that JPMorgan's earnings power was exaggerated in the past by risk-taking that has now been reduced, Mutascio said. That would bode poorly for earnings in 2013 and 2014, he added.

The bank's Chief Investment Office, where the bad trades were made, is expected to rein in its bets in many markets.

Investors should also be concerned about the impact of the loss on the company's plans to buy back stock, analyst Andrew Marquardt of Evercore Partners said in a note Thursday.

The bank suspended its buyback program shortly after announcing the trading loss because, Dimon said, it wanted to continue building capital to meet higher minimums being set by regulators.

A BLOW TO DIMON

The loss is a stunning setback for Dimon whose risk- management prowess had been virtually unquestioned until the May 10 announcement.

While the bank had loans go bad and lost billions of dollars on mortgage-related securities, it remained profitable through the financial crisis under Dimon and was strong enough to take over two failing financial institutions at the urging of the government, investment bank Bear Stearns and consumer bank Washington Mutual.

In April, Dimon confidently dismissed press reports of outsized positions at the bank's CIO office as a "tempest in a teapot." In May, he apologized to stock analysts and investors for those remarks. This month, he was called before two congressional committees to answer for the bank's mistakes.

Dimon said then that the trades had started out as hedges against losses that would come with trouble in the economy. The portfolio was mismanaged and morphed into something he said he could not defend.

Lawmakers want to know if the Volcker Rule, a pending ban on proprietary trading by banks, would have stopped the kind of losses incurred by the trader known as the London Whale and his colleagues.

U.S. Representative Barney Frank, co-author of the biggest reform law to come out of the financial crisis, said in an interview on Thursday that he was troubled by the increase in the bank's loss.

"The problem is this very highly regarded CEO at one of the best-run institutions had no idea what was going on, how much money he was losing," Frank said.

Congress Honors Black Marines

WASHINGTON -- Hundreds of African-American veterans who helped to integrate the Marine Corps during World War II at a time segregation was an everyday reality are now proud recipients of the nation's highest civilian honor.

Nearly 70 years after the Marines of Montford Point became the first African Americans in the Corps, Congress on Wednesday awarded them the Congressional Gold Medal. The Corps was the last branch of the U.S. military to allow blacks to serve.

Originally from Washington, D.C., then-19-year-old Charles Manuel Jr. enrolled with the Marines in 1942 straight out of high school.

Manuel was sent to Montford Point, a North Carolina base that the Corps created to keep African Americans away from bases where other Marines trained. Roughly 20,000 other African- American Marines trained at the base, which operated from 1942 to 1949.

He said that the training at the base was rough, because for many recruits it was their first time experiencing boot training and their instructors were White. "Our drill instructor told us, `You people want to be Marines, I'm going to make Marines out of you dead or alive.'"

Manuel, now in his late 80's, sat next to his daughter, Rosetta Holloway at the ceremony.

"It was more than overdue," Holloway said. "I'm very excited and pleased for my father, who's really proud of being in the Marines."

William McDowell, who was selected to represent Montford Point, received the medal on behalf of the roughly 400 Montford Point Marines in attendance. "It does sadden me that some of our brothers are not with us today. The upside of it all is that we do remember each and every one of them. They are in our hearts and minds and they should never be forgotten," McDowell said before taking a pause to dry his eyes.

The medal will be on display at the National Museum of the Marine Corps in Virginia. The Marines received bronze replicas.

President Franklin D. Roosevelt banned racially based employment discrimination by all federal agencies in 1941, and a presidential directive allowed African Americans to serve the Marines in 1942.

House Democratic Leader Nancy Pelosi told the Marines: "You served our country at a time that it took an extra dose of patriotism to do so. Because all of the freedoms that you were fighting for were not afforded to everyone in our country at that time."

Speaker of the House John Boehner, Senate Majority Leader Harry Reid and Senate Republican Leader Mitch McConnell also spoke.

"Allowing blacks to serve the Marine Corps was seen as an experiment," Boehner told the crowd. "If it was an experiment, it didn't last any long. Before the end of the war, the Marine commandant at the time said the experiment was over. The men trained at Montford were Marines, period."

Possible details of Google Nexus tablet emerge

Google I/O, the search engine giant's annual developer conference kicks off on June 27. As usual, things will start with a keynote, which may include some product announcements. One blog claims that it already knows which gadget?Google will show off?? a tablet dubbed "Nexus 7."

Gizmodo Australia's Luke Hopewell writes that?the blog's staff has "viewed a training document detailing exactly what?s going to be in the new tablet and how much it?s going to cost."?

According to Hopewell, the tablet will be a 7-inch device built by Asus ??which fits with earlier reports???and contain a 1.3Ghz quad-core Tegra 3 processor, GeForce 12-core GPU and 1GB of RAM.?The tablet will be come in 8GB and 16 GB versions, Hopewell explains. Its screen will supposedly be an IPS?display "with a 178-degree viewing angle, running a resolution of 1280 by 800." (This again matches a prior report by DigiTimes.)

Additionally, there will supposedly be NFC, Google Wallet, and Android Beam technology built into the device along with a 1.2 megapixel front-facing camera. The battery inside the Nexus 7 will offer 9 hours of operating time.

Hopewell writes that the?8GB version of the tablet will cost $199 and that the 16GB version will cost $249.?(Previous reports suggested that prices would range between $149 and $249, for reference.)

While leaks, rumors, and vaguely sourced reports should always be taken with a large dash of salt, there's been a lot of consistency regarding this particular device. We wouldn't be surprised if we saw it in a couple of days, at the Google I/O keynote in San Francisco, from where we'll be reporting live.

NY jury awards over $950 million to Liberty Media

(AP) ? A federal jury on Monday awarded $956 million to U.S. media group Liberty Media after concluding that the French entertainment group Vivendi deceived it in a decade-old deal involving the USA Networks.

The jury in U.S. District Court in Manhattan issued the award after hearing evidence related to a stock swap involving the network. Liberty Media had accused Vivendi of deceiving it with rosy statements about its finances when executives inside the company were aware of a liquidity crisis.

After the verdict was announced, Vivendi said in a statement it will appeal, using "all available paths of action to overturn the verdict or reduce the damages award." It added that it believes "strongly that it did nothing wrong and will continue to vigorously defend itself."

Liberty Media, in a statement of its own, said it planned to seek interest.

The verdict stemmed from a lawsuit Liberty Media brought in 2003, accusing Vivendi of waiting until its transaction with USA Networks and Liberty Media officially closed before reacting publicly to a downgrade of its debt rating and addressing surrounding concerns about liquidity.

During closing arguments, Liberty Media attorney Michael Calhoon urged jurors to "look at these internal memos, inside the company, talking about what was really going on inside the company when the company was saying to the public and to Liberty something totally different."

He referenced the stock swap surrounding the transaction, saying: "We took the risk of the price falling. We didn't take the risk of fraud."

Repeatedly in the trial, jurors heard about an email in which Vivendi's chief financial officer wrote: "I feel like I'm in the death seat of a car. I hope it doesn't end in shame."

Vivendi lawyer Jim Quinn said the company had its own reasons for closing the deal and did not rely on misleading statements.

"I think we proved that in spades," he said.

He added that "despite warnings, despite the red flags, Liberty Media did nothing to investigate the problems at Vivendi."

In the end, the jurors were left to decide whether Vivendi had made false statements in its contract with Liberty. The jury found it had and assessed damages.

Calhoon had told jurors Vivendi should "pay for their fraud."

"They shouldn't get some kind of blizzard of confusion discount," he said.

It seems that on the milestone 100th episode of the "Secret Life of the American Teenager," everyone will have Amy and Ricky's wedding on the brain. Everyone is excited, that is, except the blushing bride, who is still dealing with the very adult decision to marry her baby daddy.

"Tonight's episode... the 100th episode? We kind of, I like to say, were channeling our inner 'Glee'," the show's star Shailene Woodley (who plays Amy) told MTV News on Monday (June 25). "There might be a musical number. There might be some singing and dancing by some of the characters on the television show."

"There's a lot of shockers," she continued. "And at the end of the episode, I think some fans are going to be confused as to a decision Amy and Ricky made. There's gonna be a shocking revelation about the wedding."

While the ongoing saga of Amy and Ricky might leave fans salivating for more from the young couple as the season chugs along, Woodley notes that the most surprising thing about the episode, to her at least, just might be that teased musical moment in the show. "I think that's big," she said. "We've never done anything like that on 'Secret Life'."

Woodley notes that when she signed on to the show all those years ago, she wasn't sure they would make it to 100 episodes. "Reflecting back on 100 episodes, I think that there's been so many exciting moments for me," she said. "A quarter of my life has been spent on 'Secret Life.' I'm 20 and I've been doing it for five years, so I think the best moments have been when all the castmembers get to work together and we get to collaborate and share experiences. We all grew up together.

"I think we were all surprised it has lasted this long," she continued about the show's successful run on the network. "None of us had ever done television before and I don't think any of us knew what to expect. And the fact that it has lasted this long continues to be a shocker. I think that the themes that we deal with, although they are exaggerated, I think the themes at their core are very relatable."

Facebook's new 'Find Friends Nearby' feature: Creepy or clever?

Facebook quietly added a new feature to its mobile?website and apps this weekend. It's called "Find Friends Nearby" and it ... well, it does exactly what you'd think it might.

TechCrunch's Ingrid Lunden was among the first to call attention to the new feature, after a developer tipped her off.

You can access?Find Friends Nearby either through the iOS or Android?Facebook apps ? just open up the main?menu, tap "Apps," select "Find Friends," press "Other Tools," and then pick "Find Friends Nearby"?? or by?heading to http://fb.com/ffn?on your mobile device.

Note that you'll have to authorize either the apps or your browser to access your current location. This doesn't mean that?you're allowing either to reveal your location all the time though. As soon as you leave the Find Friends Nearby page, you'll be off the radar once again. (This makes sense because it prevents people from stalking you?invisibly or from being stalked without actively choosing to announce their location.)

While you are on the Find Friends Nearby page?? it looks the same in the apps and in the browser ? you'll be able to find out who happens to be both near you and staring at that same page.

The feature is incredibly convenient if you happen to be chatting with someone in person and want to add him as a Facebook friend. Rather than tapping out his name and wasting minutes scrolling through a list of similarly named individuals, you can just ask your new pal to open up the Find Friends Nearby page and add him with a quick tap.

Opening up the Find My Friends page, while convenient, also exposes you to potential awkward or creepy moments. There is always a chance that someone you are avoiding or not interested in interacting with ?will happen to have the same page open?? and spot your name. He or she would instantly know that you are nearby and quickly view the public information on your Facebook profile.

So the final verdict? Find Friends Nearby is incredibly convenient, but?? like many similar tools ? not without potential for disaster.?

Scots guardsmen cupcake toppers, union jacks on toothpicks, ice queen scoops. Bunting: enough to string together the old empire. Royal photos on thimbles, spoons, tea cups, shot glasses, egg cups, tea towels ? the usual tat, as the Brits say. Jubilee thongs? Yes.

Then there?s the cleverness contest surrounding the WWII-era slogan, ?Keep Calm and Carry On.? Written on a women's compact: ?Keep Calm and Powder On.?
Comparatively, Google?s doodle is an understated affair. The letter O?s are diamonds, symbolic of the 60th (diamond) anniversary on the throne. The E sits as a jewel in the queen?s crown. The queen appears in two-dimensional contour; her beloved corgis, however, look ready to leap off the page.

The playful riffs on royal themes reflect the generally favorable mood toward the royals of late.

A YouGov poll last month found 67 percent agreeing the monarchy is good for Britain, and 86 percent approve of Queen Elizabeth. This is up from the days when her children's divorces dominated the headlines and her slowness to show emotion over the death of Princess Diana frustrated many.

Still, the public mood is not really one of royal reverence. Britons are in party mode at the start of a long weekend ? Monday and Tuesday being holidays as part of the four-day official jubilee celebration. Many Londoners took the chance to flee on summer vacations, as foreign and British tourists crowd into the city for events that include Sunday?s royal family flotilla on the Thames and Tuesday?s carriage procession.

Among the street art for the crowds will be the construction Sunday of a 94-sq.-ft. portrait of Queen Elizabeth made from 3,120 squares of cake ? one for each week of her reign.

German-born baker Gerhard Jenne came up with the idea. Mr. Jenne dipped each piece of lemon cake into one of 24 frosting colors, turning each into a pixel of this icing illustration.

Jenne?s a fan of the queen, but not so much so that he feels the need to become her subject even 30 years after moving to London. He doesn?t expect to meet her on Sunday, when he publicly arranges the cake squares into the portrait.

?It?s very interesting how the queen has changed. Even from 30 years ago, [the royals] are much closer to the people now,? he says. ?You almost feel like she might come see you?. There could just be a 1 in 40 million chance.?

After spending hundreds of hours on the cake, he expects it to be gobbled up within 20 minutes when it?s opened up to the crowds.

Some customers in his Konditor & Cook bakeries have asked him if it?s proper for an image of Her Highness to be eaten.

?I just said yes, it?s fine by me. At the end of the day, it?s a cake, it?s a bit of fun. And she seems like a humorous person.?

Experts say science lacking on 9/11 and cancer

NEW YORK (AP) - Call it compassionate, even political. But ... scientific? Several experts say there's no hard evidence to support the federal government's declaration this month that 50 kinds of cancer could be caused by exposure to World Trade Center dust.

The decision could help hundreds of people get payouts from a multibillion-dollar World Trade Center health fund to repay those ailing after they breathed in toxic dust created by the collapsing twin towers on Sept. 11, 2001.

But scientists say there is little research to prove that exposure to the toxic dust plume caused even one kind of cancer. And many acknowledge the payouts to cancer patients could take money away from those suffering from illnesses more definitively linked to Sept. 11, like asthma and some types of lung disease.

"To imagine that there is strong evidence about any cancer resulting from 9/11 is naive in the extreme," said Donald Berry, a biostatistics professor at the University of Texas MD Anderson Cancer Center in Houston.

Yet this month, Dr. John Howard, who heads the federal agency that researches workplace illnesses, added scores of common and rare cancers to a list that had previously included just 12 ailments caused by dust exposure.

Lung, skin, breast and thyroid cancer were among those added; of the most common types of cancer, only prostate cancer was excluded.

"We recognize how personal the issue of cancer and all of the health conditions related to the World Trade Center tragedy are to 9/11 responders, survivors and their loved ones," Howard said in a June 8 statement.

He declined requests for an interview with The Associated Press. His decision, based on an advisory panel's recommendation, will go through a public comment period and additional review before it's final.

Several factors about the decision by the National Institute for Occupational Safety and Health raised eyebrows in the scientific community:

- Only a few of the 17 people on the advisory panel are experts at tracking cancer and weighing causal risks; they were outnumbered by occupational physicians and advocates for Sept. 11 rescue and cleanup workers.

- Exposure to a cancer-causing agent doesn't necessarily mean someone will develop cancer. And if they do, conventional medical wisdom says it generally takes decades. But the panel agreed to cover those diagnosed with cancer within just a few years of the disaster.

-The panel members favored adding cancers if there was any argument to include them. They added thyroid cancer because a study found a higher-than-expected number of cases in firefighters who responded to 9/11, even though thyroid cancer is generally linked to genetics or high doses of radiation. The same study found a lower-than-expected number of lung cancers, but it was added because it was considered a plausible consequence of inhaling toxins at the site.

Even lawyers for the first responders were stunned: They had expected to see only certain blood and respiratory cancers put on the list.

"I understand the urge to want to compensate and reward the heroes and victims of that tragedy," said Dr. Alfred Neugut, a Columbia University oncologist and epidemiologist. But "if we're using medical compensation as the means to that, then we should be scientifically rigorous about it."

When the twin towers collapsed, much of lower Manhattan was enveloped in a dense cloud of pulverized glass and cement that left people in the area gasping for air. Fires smoldered in the rubble pile for weeks. Many workers labored in the ash wearing only flimsy paper masks, and went home coughing up black phlegm. Years later, some were still experiencing mild respiratory problems.

After Sept. 11, the government established the Victim Compensation Fund, which paid out about $7 billion for the nearly 3,000 deaths from the attacks and for injuries, including some rescuers with lung problems.

In late 2010, Congress set up two programs for anyone exposed to the rubble, smoke and dust at ground zero: rescue and cleanup workers and others who worked or lived in the area. Cancer was initially excluded, but Congress ordered periodic reviews based on the latest scientific evidence.

One $1.55 billion program is for treatment for any illness determined to be related to ground zero. The second $2.78 billion fund is to compensate people who suffered economic losses or a diminished quality of life because of their illness. Both programs expire in 2016, but could be extended.

How many people might apply isn't clear. In the decade since the attacks, about 60,000 people have enrolled in the two health programs for those who lived or worked within the disaster zone of lower Manhattan. Many have signed up for medical monitoring, but around 16,000 have been getting treatment annually.

Every new illness added to the list means less money for the group as a whole, especially when dealing with major diseases like cancer, acknowledged Sheila Birnbaum, the special master handling applications to the compensation fund.

Registration for the compensation program only began in October. How the money will be divvied up, or whether it will be enough, isn't clear, Birnbaum said. People with the gravest health problems would get the largest amounts, with cancer payments likely among the most sizable.

Applicants could qualify for treatments and payments as long as they and their doctors make a plausible case that their disease was connected to the caustic dust.

But is Sept. 11 really to blame for every cancer case?

Overall, roughly 1 in 2 men and 1 in 3 women will get cancer over their lifetimes. And generally, the more you look for cancer, the more cases you find. People worried that they got sick from the World Trade Center attacks are likely going to doctors more than other people. So some slow-growing cancers that started before 9/11 but were found afterward could end up being blamed on the fallout.

Reggie Hilaire was a rookie police officer when the hijacked planes flew into the World Trade Center. He spent the initial weeks after the attacks patrolling Harlem, miles away from the disaster zone, then was sent to Staten Island, where he spent weeks at a city landfill sorting through rubble and looking for human remains.

At the landfill, he wore a Tyvek suit, boots, gloves and a respirator to protect him. Months later, he also worked as a guard near ground zero, wearing no protective gear but never working on the debris pile itself.

Hilaire didn't develop the hacking cough or other problems experienced by those who inhaled big doses of soot. But he worried about his health, periodically visiting doctor's offices and clinics.

In 2005, at age 34, a lump showed up in his neck. He was diagnosed with thyroid cancer and successfully treated. Months later, he got more bad news: Doctors noticed he was anemic and investigated, leading to diagnosis of a second cancer - multiple myeloma, a blood cancer normally seen in the elderly.

Since roughly half of people with the diagnosis never get sick from it, doctors monitor a patient's condition rather than put them through chemotherapy and other difficult treatments - which is the case with Hilaire, still on the force. His medical bills have been covered by insurance, and to date, he hasn't applied for compensation from the federal fund.

Doctors don't know what causes multiple myeloma, but say genetics plays a role and that it is more common in black men. Hilaire, who is black, is convinced that toxins at ground zero are to blame.

"I've had cancer twice since 9/11, and I'm 41 years old," he said. "It would be some coincidence."

The U.S. government traditionally has been cautious about labeling things as cancer-causing agents, choosing to wait for multiple studies to confirm and reconfirm such a conclusion.

The famed 1964 surgeon general's report that permanently tied smoking to lung cancer came out more than a decade after a series of studies showed the link. The Environmental Protection Agency has taken decades to decide about other carcinogens. Howard's agency, NIOSH, has a conservative reputation as well.

But with this decision, Howard broke from that history.

"I think this was a special case," said Richard Clapp, a professor emeritus of environmental health at Boston University.

No question, bad stuff was in the air and on the ground. Asbestos, lead, mercury, PCBs and dioxins were all found at the smoldering World Trade Center site for months after the terror attacks. Dioxins have been associated with promoting the growth of some pre-existing cancerous cells, Clapp noted.

Previous studies have shown some of the contaminants - like asbestos, arsenic and soot, for example - have led to cancers in workers exposed to hefty amounts for long periods of time.

The fallout was a terrible mixture of toxins with significant potential to harm people, said Elizabeth Ward, an American Cancer Society vice president and cancer researcher who headed the advisory panel that made the recommendation to Howard.

"This was a really unique exposure," said Ward. Based on the best available evidence, the panel decided it was likely that people could get cancer, she said, and that it was better to offer help now than when it was too late.

Indeed, Howard and Ward have a number of supporters in the public health and scientific community who think it was the wisest decision, given the large human need.

"I think for Dr. Howard, it's a very tough decision to make. I'm sure he knew that whatever he said, people are going to complain about it," said Daniel Wartenberg, an epidemiology professor at the University of Medicine & Dentistry of New Jersey.

"In my view, I hope he is wrong. I hope no one gets sick," he added.

A mere two years after 9/11, former New York City police detective John Walcott, 47, was successfully treated for a common type of leukemia that doesn't hit most people until about age 60.

Walcott arrived at the World Trade Center just after the second tower fell and spent months searching for human remains - on the pile, in empty buildings nearby, and later at the city landfill where the rubble had been taken.

He was so sure his cancer would eventually be covered by the federal program, he dropped his negligence lawsuit against the city last winter, as was required to remain eligible for the fund.

He is well aware that some scientists question whether illnesses like his were really caused by ground zero toxins. But he has no doubts.

"My heart told me I got it from there," he said.
